Savitha Kesav Jagadeesan is the Senior Resident Partner, based in the firm's Chennai office. In addition to heading the IP practice in Chennai, her areas of expertise include employment law, corporate transactional law and TMT.
Ms Jagadeesan provides extensive advice on labour matters, including employer-employee disputes, termination issues and industrial relations. Her work involves advising on retrenchments, terminations and layoffs under Indian labour laws. She has further conducted domestic inquiry processes and advised on labour transaction matters, such as company unit hive-offs, business transfer agreements, asset purchases and acquisitions.
Meanwhile, she has provided guidance on employee hires in foreign holding companies and speaks at various forums – also facilitating training on employment-related issues, including labour compliance, the new labour codes and other subjects related to employment law. She has served as an external member of the Internal Complaints Committee (IC) for several companies, advising on matters related to workplace harassment and the Prevention of Sexual Harassment (POSH).
She commented: “Notably, I was involved in the setup of the GCC on its entry into India, advising on a variety of employment issues, such as preparation of employment contracts, service contracts with clients, review of employment policies, as well as advice on aspects related to overtime and gratuity payments. More recently, I assisted a Fortune 500 company in selling of one of its business verticals along with its employees to another entity, which included strategising the structure of the hive-off, drafting and negotiating the business transfer agreements, as well as advice on the steps for employee transfer.”
In her other specialist areas, Ms Jagadeesan advises numerous large foreign and domestic clients on negotiating and managing joint ventures, private equity investment documentation, FDI, technical collaborations, share and asset purchase deals, M&A, as well as investment strategies in India. In addition to dealing with traditional IP rights issues, she manages IP portfolios – in both litigation and prosecution – across diverse industry sectors, including FMCG, auto parts, IT, education, media and entertainment.
Regarding her accolades, Ms Jagadeesan has been featured by Forbes India as one of the Top 100 Legal Professionals in India. Business Today named her among the Top 15 lawyers in Corporate Commercial Law in Chennai, Tamil Nadu, India. Moreover, she is included in the prestigious A-List of the India Business Law Journal among India's Top 100 Legal Professionals, and has been recognised as one of the Top 100 IP Professionals by Asia IP – as well as among the top 100 Women IP Professionals by the World IP Forum.
