Frequently asked questions

What legal system does Croatia have?

Croatia has a civil law system in the continental European tradition, historically shaped mainly by Germanic and Austrian law from the country's time in the Austro-Hungarian Empire. Law is set out mainly in codes and statutes rather than judicial precedent. Under the Constitution, Croatian and the Latin script are in official use, and under the Civil Procedure Act civil proceedings are conducted in Croatian unless another language has been introduced by law for particular courts.

How do I check that a lawyer is qualified in Croatia?

Lawyers in Croatia are called odvjetnici, and under the Legal Profession Act providing legal assistance as an occupation is reserved to them, unless a law provides otherwise. The Croatian Bar Association (Hrvatska odvjetnička komora) keeps the Register of Lawyers (Imenik odvjetnika), and its website has a public search of lawyers, law firms, joint law offices and trainees, as well as a separate register of foreign lawyers. Check that anyone you instruct appears there.

Which courts handle commercial disputes in Croatia?

Croatia has specialised commercial courts (trgovački sudovi). Under the Courts Act they decide civil and non-contentious matters where a special law provides, keep the court registers of companies, decide on applications concerning the formation, operation and dissolution of companies, and conduct bankruptcy and pre-bankruptcy proceedings. Appeals against their first instance decisions go to the High Commercial Court of the Republic of Croatia, which sits in Zagreb.

How much does a lawyer cost in Croatia?

Croatian lawyers' fees are governed by an official tariff. Under the Legal Profession Act, lawyers are entitled to fees and expenses in line with the Tariff of Fees and Expenses adopted by the Croatian Bar Association with the consent of the Minister of Justice and published in the official gazette (Narodne novine). The Tariff sets fees in points, for example 25 points per hour where no other item applies. Ask for a written estimate, and a lawyer must give you an invoice after the work.

Do I need a local lawyer or adviser in Croatia if I am based abroad?

Often, yes. Legal assistance as an occupation is generally reserved to lawyers entered with the Croatian Bar Association, and civil proceedings are conducted in Croatian. Company registrations and changes are handled by the commercial courts, which keep the court register. A local odvjetnik can deal with the courts and authorities for you, and you can confirm their status in the Croatian Bar Association's Register of Lawyers.
