What legal system does Hungary have?
Hungary is a civil law jurisdiction, so legislation is the main source of law and judicial case law is not formally a source of law, although the Kúria (the Supreme Court) issues binding uniformity decisions to keep the application of the law consistent. Under the Fundamental Law, the official language is Hungarian, and under the Code of Civil Procedure the language of court proceedings is Hungarian, with rights to use your mother tongue orally in certain cases.
How do I check that a lawyer is qualified in Hungary?
Attorneys in Hungary are called ügyvédek and practise under Act LXXVIII of 2017 on attorneys. They must be members of a regional bar association; the national body is the Hungarian Bar Association (Magyar Ügyvédi Kamara). The law requires the public data in the bar's register to be published and kept up to date in the official lawyer search (ügyvédkereső), so you can confirm that an attorney or law office is registered before you instruct them.
Do I need a lawyer to register a company in Hungary?
Yes. Under Act V of 2006 on company registration, registering a company or a change to its details is an electronic non-contentious court procedure in which legal representation is mandatory, and the application must be submitted through a legal representative. Applications are decided by the regional courts acting as courts of registration (cégbíróság). The legal representative also confirms that the documents filed have been checked for legality.
How much does a lawyer cost in Hungary?
Fees depend on the adviser and the work. Many lawyers charge by the hour, while some offer a fixed fee for defined tasks. Before you instruct anyone, ask for a written estimate or engagement letter that sets out how fees and expenses will be charged. Under Hungary's law on attorneys, you and the attorney are free to agree the fee. However, any part of a success fee that exceeds two thirds of the total fee cannot be enforced in court.
Do I need a local lawyer or adviser in Hungary if I am based abroad?
In many cases, yes. Company registration and changes must go through a legal representative, and court proceedings and submissions are in Hungarian unless the law provides otherwise. A local ügyvéd can file with the court of registration, represent you before Hungarian courts and authorities, and handle documents while you remain abroad. You can check their registration in the Hungarian bar's official lawyer search.
