What legal system does Luxembourg have?
Luxembourg has a civil law system. Its civil law is based on the French Code Napoléon, while company, commercial and criminal law drew mainly on Belgian sources. The official Luxembourg portal explains that ordinary courts hear civil, commercial and criminal cases, administrative courts hear disputes with the public administration, and a Constitutional Court rules on whether laws comply with the Constitution. Under the Languages Law of 1984, French, German or Luxembourgish may be used in judicial matters, and legislation is written in French.
How do I check that a lawyer is qualified in Luxembourg?
The Council of the Ordre des avocats du Barreau de Luxembourg decides on admission to the Tableau de l'Ordre. List I contains avocats à la Cour, who have completed the judicial traineeship and passed the final exam, list II contains avocats who are still in their traineeship, and list IV contains EU lawyers practising under their home title. Every avocat must take an oath before the Cour de cassation. The Bar's website lets you search for a lawyer by name or firm.
Do I need a notary to set up a company in Luxembourg?
For many company forms, yes. Guichet.lu, the official business portal, explains that a private limited company (SARL) must be formed in the presence of a notary, needs share capital of at least EUR 12,000, and must file its articles of association with the Trade and Companies Register (RCS), run by Luxembourg Business Registers. An avocat can advise you on the right structure and the authorisations your business needs, while the notary executes the deed of incorporation.
How much does a lawyer cost in Luxembourg?
Lawyers usually charge by the hour or agree a fixed fee for a defined piece of work, and the cost depends on the complexity of your matter and the experience of the adviser. Ask for a written estimate and the terms of engagement before any work starts. If you dispute a final fee note, you can ask the Council of the Ordre des avocats du Barreau de Luxembourg to review it through its taxation des honoraires procedure, which considers the difficulty of the matter, the work done, the lawyer's experience and the result obtained.
Do I need a local lawyer or adviser in Luxembourg if I am based abroad?
Not always, but it usually helps. The two district courts, in Luxembourg City and Diekirch, hear all civil and commercial matters not assigned by law to another court, and proceedings use French, German or Luxembourgish. Setting up a company involves a notary and filing with the Trade and Companies Register (RCS). A local avocat can represent you, deal with filings and work with you remotely by email and video call, so you rarely need to travel.
