Agus Dwi Prasetyo, Managing Partner of ADP Counsellors at Law, has more than a decade’s experience in insolvency and commercial litigation.
Mr Dwi Prasetyo specialises in bankruptcy, debt restructuring, corporate reorganisation and business closure, and is widely recognised for his strong negotiation and litigation capabilities. He is a member of the Indonesian Advocates Association (PERADI) and the Indonesian Association of Receivers & Administrators (AKPI), reflecting his active involvement in the country’s legal and insolvency community.
Today, Mr Dwi Prasetyo provides comprehensive legal services in the field of insolvency, advising and representing clients in Suspension of Debt Payment Obligations (PKPU) and bankruptcy proceedings, including appointments as court-appointed administrator or receiver. His work further includes the verification and reconciliation of creditors’ claims, formulation of debt restructuring schemes, as well as legal handling of liquidation and business closure. Combining strategic legal insight with a strong understanding of commercial realities, he offers effective solutions for both debtors and creditors.
Meanwhile, he regularly assists clients from various sectors, such as financing companies, national and international banks, oil and gas enterprises, as well as state-owned companies – addressing legal needs related to insolvency, restructuring, dissolution and commercial disputes.
Professional Highlights: Bankruptcy, Insolvency & Restructuring
• Represented a leading Indonesian private bank in filing a petition for the annulment of a ratified peace agreement (homologation) against an Internet service provider by reviewing the fulfilment of obligations under the agreement, as well as preparing for further insolvency proceedings, with a transaction value of IDR 90,073,986,006.32;
• Acted as administrator in a court-supervised Suspension of Debt Payment Obligations to facilitate the formulation of a fair and acceptable debt restructuring scheme, verified creditors’ claims, conducted reconciliation and classification of debts in compliance with prevailing laws, with a transaction value of IDR 86,689,095,853;
• Assisted a leading Indian palm oil plantation company in serving as the liquidator for the liquidation and dissolution of two Indonesian subsidiary companies, with total managed assets amounting to IDR 15,634,756,569.
