Hemant Singh is a well known IP litigator in India as well as managing partner and founder member of a leading intellectual property law firm ‘INTTL ADVOCARE’. He joined the bar in 1984 and ever since, has practiced exclusively in the field of intellectual property rights. He had the opportunity of being involved in significant judicial pronouncements emanating from various courts in India. INTTL ADVOCARE, the IP boutique firm has grown steadily from having national to international clientele under the leadership of Hemant Singh. He has handled over 1700 IP litigations in various courts and argued complex legal issues in the field of intellectual property such as to what constitutes prior use vis-à-vis overseas brand owner, requirement of trade mark usage to constitute infringement, use of trade mark by ancillary industry falling within permitted use and exceptions to infringement, inventive step and test of obviousness for valid patent, exclusion of functional and utilitarian shape as trade mark, injunction against parallel import of goods in India, proprietary right in respect of generic and descriptive marks, requirement of compliance of principles of natural justice in case involving renewal of lapsed trade mark registrations, estoppel against licensee challenging proprietary right of a licensor etc.
He is the Chairman of Intellectual Property Committee of the oldest Associated Chambers of Commerce and Industry in India (ASSOCHAM) since 2010 and Member of CII National Committee on IP since 2011 and involved in various ongoing debates and deliberations for further strengthening intellectual property protection and enforcement in India.
He is a keen participant in several trade mark and trade name sub committees of several IPR bodies including INTA, APAA etc. He has also authored several articles published in various intellectual property magazines worldwide and has been speaker on various intellectual property topics in various countries.
Hemant Singh is also a registered patent agent and involved in number of patent litigations involving complex patent issues.
