Dr. Pavlos Neofytou Kourtellos

Dr. Kourtellos has extensive experience on civil and commercial litigation before the District Courts and the Supreme Court of Cyprus with a particular emphasis on commercial, corporate and shareholders’ disputes, fraud and conspiracy issues. He has a broad commercial background and he is also engaged in advising on issues related on Cyprus International Trusts and Investment Services.

He has also handled numerous cases in relation to administrative acts concerning matters of administrative, tax and constitutional law and he has been consulted to give opinions on different aspects of Cyprus law, especially with respect to cases involving complex multi-jurisdictional issues, arbitration law and has been engaged in a number of high profile cases.

Dr. Kourtellos in addition to maintaining his own law practice is also an Associate Lecturer at the University of Cyprus (Department of Law) teaching Equity & Trusts, Private International Law and Philosophy of Law.

In the recent years Dr. Kourtellos has secured precedent-setting victories in the area of disclosure of information and confidentiality, the tracing of assets, arbitration law and insolvency proceedings. The choice of legal strategy entails various business and financial consequences and adopting the appropriate legal approach is of the highest value.

Indicative of the recent cases he has been involved are the following:

Representing successfully a co-defendant within the frame of contempt proceedings in respect to allegations of failure to comply with Norwich Pharmacal orders. The contempt proceedings dismissed and rejected arose from the unanimous judgment of the Supreme Court of Cyprus delivered in Avila Management Services Ltd e.a. –v- Frantisek Stepanek e.a. Civil Appeal 54/2012, 27/6/2012, (the “STEPANEK”) one of the very few adjudicated applications of this nature on appellate level relating to the jurisdiction of the Cypriot Courts to issue Disclosure orders otherwise known as Norwich Pharmacal.

Successfully representing the Defendant-Respondent in respect to fraud and conspiracy claims raised by entities affiliated to Rusal a leading, global aluminium producer and one of the world's major producers of alumina, and obtaining judgment against the use and/or an order preventing the use inside jurisdiction and abroad of confidential documents illegally obtained and/or disclosed to the Plaintiffs on behalf of a Cyprus Bank. The judgment sets a case precedent in respect to the issues resolved.

Handling successfully the Defense on behalf of a Cyprus Company against the registration in Cyprus of an Arbitral Award issued by the International Commercial Arbitration Court of the Chamber of Commerce and Industry (Russian Federation). The District Court's judgment sets out a case precedent on the subject matter.

Handling the winding up proceedings against Orfanides PLC, a high profile Cyprus public company and among the major malls and supermarket chain operators.
