Frequently asked questions

What legal system does Denmark have?

Denmark belongs to the Nordic legal family. Danish law shares many features with continental European civil law systems but has developed its own character, with some common law traits. Its main sources of law are the Constitutional Act, statutes, regulations, precedent and customary law, and much of it is shaped by EU law. Under the Administration of Justice Act (retsplejeloven), the language of the courts is Danish, and documents in other languages must be accompanied by a translation.

How do I check that a lawyer is qualified in Denmark?

The title advokat is protected. Under the Administration of Justice Act, lawyers are appointed by the Minister of Justice, and membership of the Danish Bar and Law Society (Advokatsamfundet) is mandatory for every practising advokat. The Society's official directory, Advokatnøglen, contains information about all Danish lawyers and lets you search by name, firm, area or field of law. Complaints about a lawyer's conduct or fees go to the Disciplinary Board (Advokatnævnet).

Which court handles commercial disputes in Denmark?

Most civil cases start in the district courts, but the Maritime and Commercial High Court (Sø- og Handelsretten) handles specialist business cases. Under the Administration of Justice Act, cases can be brought there, unless the parties have agreed otherwise, where expertise in international business matters is important, as well as many cases on transport, trade marks, designs, patents, competition law, marketing law between businesses and trade secrets. It also hears cases on EU trade marks and designs.

How much does a lawyer cost in Denmark?

Fees depend on the adviser and the work. Many lawyers charge by the hour, while some offer a fixed fee for defined tasks. Before you instruct anyone, ask for a written estimate or engagement letter that sets out how fees and expenses will be charged. Under the Administration of Justice Act, an advokat may not charge more than a reasonable fee, and the Disciplinary Board (Advokatnævnet) can reduce or waive a fee it considers unreasonable.

Do I need a local lawyer or adviser in Denmark if I am based abroad?

For court work, usually yes. Under the Administration of Justice Act, advokater have the exclusive right to conduct cases in court on behalf of others, subject to limited exceptions, and proceedings are conducted in Danish. A local advokat can also advise on Danish and EU rules for your business, and you can check any lawyer you are considering in the Danish Bar and Law Society's directory, Advokatnøglen.
